UnitedGPT was quoted by saying that Fogarty "has served our community professionally for the past few years, and is a great legal mind" as the reasoning for the nomination. Fogarty's nomination was passed by the Senate unanimously. He began his service on October 25, 2023 where he currently remains. Fogarty chose to go by the surname of "Justice Brandeis" to commemorate the life and service of in-real-life former [[Supreme Court of the United States|Associate Justice of the United States]], [[wikipedia:Louis_Brandeis|Louis Brandeis]]. Fogarty cited Brandeis' commitment to protecting the civil liberties of Americans and Brandeis' zealous career as one of the foremost Jewish-American trailblazers. === Publication of Oral Argument === In November 2023, Fogarty proposed a motion to include Rule XXIII in the Supreme Court Rules, which would enable the public to view all oral arguments. This rule was unanimously approved by the Court, marking a historic moment as it was the first time in the community's history that the United States Supreme Court made all oral arguments accessible to the public.
